1. Introduction

Welcome to Focus Media ("we," "us," or "our"). We provide professional photography and videography services in California. By booking our services, you ("Client") agree to be bound by these Terms and Conditions.

2. Services

‍

Focus Media offers a range of photography and videography services. The specific scope of work, including deliverables, timelines, and any special requests, will be outlined in a separate service agreement or project proposal. Additional services not specified in the original agreement may incur extra charges.

3. payment & late fees

‍

• Full Payment: Full payment is due upon delivery of media at the time of download. Media will remain locked in the client’s property gallery until payment is received.
• Late Fees: Overdue payments are subject to a $25/week late fee at our discretion.
• Long-Term Delinquency: Payments overdue past one month are subject to an additional $100/month or 10%/month late fee, whichever is higher, at our discretion.
• Non-Payment Consequences: Booking a service with Focus Media means you acknowledge and accept the payment schedule outlined in your quote/order, including applicable late fees. If a bill remains unpaid for more than 4 weeks, we reserve the right to report the outstanding balance to relevant parties, including the California Department of Real Estate (DRE) and your brokerage office.

4. Time, Cancellations, & Weather Policy

• Appointment Confirmation: By confirming your appointment, you agree to Focus Media’s cancellation and rescheduling policy.
• Rescheduling & Cancellations: Cancellation or rescheduling is allowed up to 24 hours before the appointment with no penalty. Cancellations or reschedules within 24 hours of the scheduled appointment will result in a $75 fee.
• Weather Policy: We do not charge a rescheduling fee for weather-related circumstances. However, the decision to reschedule due to weather is at the client’s discretion. Aerial/drone services cannot be performed in rainy or high-moisture conditions or during hazardous wind conditions. If the client wishes to reschedule due to weather conditions, we ask that they do so at least 24 hours before the appointment.

5. Turnaround Time & Rush Delivery

• Standard Turnaround Times:

  • Photos: Next-day delivery by the end of the business day.
  • Video: Typically 3–5 business days.

• Rush Delivery Options: Next-day video delivery is available for an additional $100 rush fee. Availability is not guaranteed and depends on our current schedule.

6. Travel & Additional Fees

‍

• Travel Fees: A travel fee applies for locations beyond 10 miles from our base location. The fee is $1.00 per mile beyond this radius.
• Extended Time for Larger Properties: If booking an Elite, Premium, or Legendary Package, please allow 3+ hours for completion. Homes with significant square footage may require additional time for photography or videography services.

7. Media Usage & Licensing

• Client Usage Rights: Upon full payment, clients receive full rights to use the final media for marketing and promotional purposes.
• Focus Media Usage Rights: We retain the right to use any photos or videos for our portfolio, marketing, and promotional purposes unless otherwise agreed in writing.
• Edits & Modifications: Any additional edits or third-party modifications must be approved by Focus Media to ensure brand consistency.

8. On-Site Expectations

‍

• Property Preparation: Clients are responsible for ensuring the property is staged and ready for photography or videography upon our arrival.
• Delays: If the shoot is delayed due to the property not being ready, additional time will be billed at $200 per hour.

9. Limitation of Liability & Indemnification

‍

• Limitation of Liability: While we commit to delivering high-quality work, Focus Media is not responsible for any lost sales or perceived damages resulting from delivery delays, rescheduling, or cancellations.
• Indemnification: Clients agree to indemnify and hold harmless Focus Media from any liability, damages, or claims arising from the use of the final media.

10. Governing Law & Dispute Resolution

‍

These Terms shall be governed by the laws of the State of California. Any disputes will be subject to binding arbitration, unless otherwise agreed in writing by both parties.

11. Changes to Terms

‍

Focus Media reserves the right to modify these Terms & Conditions at any time. Any changes will be effective immediately upon notification. Continued use of our services after changes constitutes acceptance of the updated Terms.

12. Agreement & Acknowledgment

‍

By proceeding with our services, the client acknowledges and agrees to all of the terms and conditions outlined above.
